This privacy policy ("Privacy Policy") describes the privacy practices of Imaginvy, a digital invitation platform with AI image generation capabilities operated and owned by Insightful Future LLC (collectively referred to as "Imaginvy," "we," "us," or "our"). This Privacy Policy explains how we handle personal information that we collect through our website, applications, digital invitation platform, AI image generation tools, and through other interactions and correspondence with you (collectively, the "Services"). If you are located in the European Economic Area ("EEA") or the United Kingdom ("UK"), "personal information" means any information relating to an identified or identifiable individual. By using our Services, you agree to this Privacy Policy with Insightful Future LLC (doing business as Imaginvy) and accept the collection, use, disclosure, and procedures described herein. If you do not agree to this Privacy Policy, you should not access or use our Services. Beyond the Privacy Policy, your use of our Services is also subject to our Terms of Use.

  • Design Preferences, including template selections, color schemes, fonts, and layout choices for your digital invitations.
  • AI Generation Inputs, such as text prompts, descriptions, and preferences you provide to generate AI images.
  • User-Generated Content, including:
    • Pictures, which may contain images of your face or other identifying features
    • Custom design elements you upload
    • Text content for invitations
    • AI-generated images you create using our platform
    • Custom templates or designs you create
  • Communications that we exchange with you, including when you contact us via our website, applications, or support channels with questions, feedback, or otherwise.
  • Payment information required by our payment processor, Stripe, Inc., needed to complete your transactions to use our Services, including name, payment card information, and billing information. We do not store payment card numbers.
  • Marketing information, such as your preferences for receiving our marketing communications, and details about your engagement with those communications.
  • Service Usage Data, including:
    • Invitation sending history
    • Guest response tracking
    • AI image generation history
    • Template usage patterns
    • Platform interaction data
  • Other data not specifically listed here, which we will use as described in this Privacy Policy or as otherwise disclosed at the time of collection.

Automatic data collection

We and our service providers may automatically log information about you, your computer or mobile device, and your interaction over time with our Services, our communications and other online services, such as:

  • Device data, such as your computer's or mobile device's operating system type and version, manufacturer and model, browser type, screen resolution, RAM and disk size, CPU usage, device type (e.g., phone, tablet), IP address, unique identifiers (including identifiers used for advertising purposes), language settings, mobile device carrier, radio/network information (e.g., WiFi, LTE, 4G), and general location information such as city, state or geographic area.

Your choices

  • Access or update your information. To keep your information accurate, current, and complete, please contact us as specified below. We will take reasonable steps to update or correct information in our possession that you have previously submitted via the Services. This includes your guest lists, event details, and invitation preferences.
  • Manage your invitations and guest data. You can:
    • Edit or delete guest information
    • Update event details
    • Modify invitation designs
    • Delete AI-generated images
    • Control invitation visibility
    • Manage guest responses
  • Opt out of marketing communications. You may opt out of marketing-related emails or texts by following the opt-out or unsubscribe instructions at the bottom of the marketing communication we send you, or by contacting us through our contact page. Even if you opt out of marketing-related communications, you will continue to receive service-related messages about your invitations, guest responses, and other essential features.

Data Retention

We retain your personal information for as long as your account is active or as needed to provide you with our Services. If you wish to have your personal information deleted, you must both: (1) delete your account and (2) submit a specific request for data deletion through our contact page. Upon receiving both your account deletion and data deletion request, we will delete your personal information within 30 days, except where we are required by law to maintain certain records or where we need to preserve data for legal, security, or fraud prevention purposes. This includes:

  • Account Information: Maintained while your account is active, deleted within 30 days of receiving both account deletion and data deletion request
  • Guest Lists and Event Details: Accessible while your account is active, deleted within 30 days of receiving both account deletion and data deletion request
  • AI-Generated Images: Retained while your account is active, deleted within 30 days of receiving both account deletion and data deletion request
  • Invitation Designs: Maintained while your account is active, deleted within 30 days of receiving both account deletion and data deletion request
  • Usage Data: Retained as required by law or for legitimate business purposes
  • Payment Records: Retained as required by applicable tax and accounting laws
  • Security Logs: Retained as necessary for security, fraud prevention, and legal compliance purposes

Please note that simply deleting your account without submitting a specific data deletion request will not automatically result in the deletion of your personal information.

We may retain certain anonymized or aggregated data derived from your personal information after account deletion and/or data deletion request, but this data will not be personally identifiable to you.

In cases where we are required by law to maintain records, such as for tax purposes, fraud prevention, or legal compliance, we will retain the minimum necessary information for the period required by law. Additionally, if there are any pending legal issues, investigations, or disputes related to your account, we may retain the relevant information until such matters are fully resolved.

Security practices

We use reasonable organizational, technical and administrative measures designed to protect against unauthorized access, misuse, loss, disclosure, alteration and destruction of personal information we maintain. Our security measures include:

Unfortunately, data transmission over the Internet cannot be guaranteed as completely secure. Therefore, while we strive to protect your personal information, we cannot guarantee the security of personal information.

Children

Our Services are not intended for use by children under 13 years of age. If we learn that we have collected personal information through the Services from a child under 13 without the consent of the child's parent or guardian as required by law, we will delete it. This includes:

  • Guest information
  • Event details
  • Generated images
  • Invitation content

International Visitors

Our Services are hosted in the United States ("U.S.") and intended for visitors located within the U.S. If you choose to use our Services from the EEA, the UK or other regions of the world with laws governing data collection and use that may differ from U.S. law, then please note that you are transferring your personal information outside of those regions to the U.S. for storage and processing.

We may transfer personal information from the EEA or the UK to the United States and other third countries based on European Commission-approved or UK Government-approved Standard Contractual Clauses, or otherwise in accordance with applicable data protection laws. This includes:

We may also transfer your personal information from the U.S. to other countries or regions in connection with storage and processing of data, fulfilling your requests, and operating our Services. Your continued access and use of our Services after any modification indicates your acceptance of the updated Privacy Policy.
